Terms of Use — Equine Intelligence

These Terms of Use ("Terms") govern your access to and use of the Equine Intelligence website, platform and services (the "Service"), operated by Equine Science ("Equine Intelligence", "we", "us", "our"). By accessing or using the Service, or by creating an account, you agree to these Terms. If you do not agree, do not use the Service.

These Terms should be read together with our Privacy Policy.

1. About the Service

Equine Intelligence is a sports-analytics platform that compiles publicly published equestrian competition results into rankings, ratings (including our proprietary "EI Rating"), benchmarks and performance analytics. The Service is provided for informational and analytical purposes.

2. No affiliation or endorsement

Equine Intelligence is an independent service. We are not affiliated with, endorsed by, sponsored by, or an official provider to Equestrian Sports New Zealand (ESNZ), any regional or discipline body, any event organiser, or any third-party results platform, unless we expressly state otherwise in writing. References to events, organisations, riders or horses are for identification and analysis only and do not imply any affiliation or endorsement.

3. Eligibility and accounts

  • You must be at least 16 years old, or have the consent of a parent or guardian, to create an account.
  • You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly of any unauthorised use.
  • You agree to provide accurate account information and to keep it up to date.

4. Subscriptions, payment and cancellation

  • The Service offers a free tier and paid subscription plans. Features included in each plan are described on the Service and may change from time to time.
  • Paid subscriptions are billed through our third-party payment provider (Stripe) on the cycle shown at purchase (monthly or annual) and, unless cancelled, renew automatically for successive periods.
  • You may cancel at any time; cancellation takes effect at the end of the current paid period. Except where required by law, fees already paid are non-refundable.
  • We may change prices on reasonable notice; changes apply from your next billing period.
  • Paper-credit game features (if offered) have no monetary value and cannot be exchanged for cash.

5. Licence to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal or internal business use. All rights not expressly granted are reserved.

6. Acceptable use

You must not, and must not permit others to:

  • copy, scrape, crawl, harvest, or use automated means to extract data from the Service;
  • reproduce, republish, redistribute, sell, licence, or commercially exploit our rankings, ratings, analytics, compilations or other content, in whole or in substantial part;
  • use the Service to build or train a competing product or dataset;
  • reverse engineer, interfere with, or attempt to gain unauthorised access to the Service or its systems;
  • use the Service unlawfully, or in a way that infringes the rights of others or misrepresents the data.

7. Intellectual property

The Service — including its software, design, text, rankings, ratings (including the EI Rating methodology), benchmarks, analytics, and the selection, arrangement and presentation of data (the "Platform Content") — is owned by us or our licensors and is protected by intellectual property laws. Underlying factual competition results may be publicly available, but the compilation, analysis, methodology and presentation are ours. You may not use the Platform Content except as permitted by these Terms.

8. Accuracy, and no reliance

The Service is derived from third-party published competition results and automated analysis. While we take care, we do not warrant that the information, rankings or ratings are accurate, complete, current, or error-free. The Service is provided "as is" and "as available".

You must not rely on the Service as the sole basis for any decision. In particular, the Service is not advice and must not be relied on for betting or wagering, buying, selling or breeding decisions, or any financial, legal or professional decision, without your own independent verification and advice.

9. Corrections and competitor requests

If you believe information about you or your horse is inaccurate, or you wish to have your performance information removed or suppressed, contact our Privacy Officer at office@equinescience.co.nz. We handle such requests in accordance with our Privacy Policy.

10. Consumer law

Nothing in these Terms is intended to limit or exclude any rights you may have under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot lawfully be excluded. Where you acquire the Service for the purposes of a business, you agree that those Acts do not apply to the extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, and subject to section 10:

  • we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data, or opportunity, arising from your use of, or inability to use, the Service; and
  • our total aggregate liability arising out of or in connection with the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the liability (or NZ$100 if you paid nothing).

12. Indemnity

You agree to indemnify us against any loss, damage, cost or expense we suffer arising from your breach of these Terms or your misuse of the Service.

13. Suspension and termination

We may suspend or terminate your access to the Service (including for breach of these Terms) at any time. You may stop using the Service at any time. Sections that by their nature should survive termination (including sections 6–12 and 14) will survive.

14. Changes to the Service and these Terms

We may modify or discontinue features of the Service, and may update these Terms from time to time. The current version, with its effective date, will be available on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
